Conditions and Stipulations

Rio Essequibo the  19th of August 1762

Conditions and stipulations which content shall guide captain Jan Menkenveld, commanding the ship The Unity, in selling his brought slaves in public and to the highest bidder.

Since these sales are outside the risk of the auction master, all of the respective buyers will be obliged to advance a good and sufficient guarantee.  These deposits will be considered as having renounced that very beneficium, which prescribes that the deposit is not accountable before  the main debtor  is in default.

The payments will be made using good letters of exchange or hard cash, and  in three instalments, these being: the first three months after the day, the second four months later and the third or last, again four months after date, so that the full payment will be have to have been made between the first day and eleven months.  In order to encourage the buyers not to allow the ship to leave with ballast, you will negotiate that for each bought slave the first instalment will include two oxheads of good sugar, or as much in coffeebeans or other products.  These sugars will be paid for against 4 Dutch 18th century currencyduijten per lb. goods in addition to two shillings   a kind of insuranceordinaire havarije per oxhead, and for the coffeebeans against 6 duijten per lb.  All this will be delivered on board freely, according to custom, and if necessary, the auction master will draft a bill and decide that the aforementioned sugars will be set at a certain provisional price.  For every oxhead ƒ 75 will be charged, with the understanding that the aforesaid will be sugars and remain as a bill for the loaders.  Should the price of an oxhead exceed the calculated ƒ 75 in the native country this will be to their benefit in the next instalments.  In the same way, they will have to reimburse the costs should the oxheads  yield less than that sum. It is fully up to the buyers to choose whether to address the bills for the sugars to their respective correspondents or whether to let these be accounted for by the auction master according to the sales in the fatherland.  These will also take place according to the choice of the gentlemen buyers regarding the insurance.

In addition to this, it will be negotiated that in case the directors of the Commercie Compagnie of the city of Middelburg in Zeeland allow for a ship to be sent to these rivers to collect the final instalment, the buyers will undertake to pay for these loads as well.  Regarding the relation between load and price, see the abovementioned regulations.

All slaves which are found to have the sleeping or falling sickness may be returned within 6 weeks.  If any defect in the face is observed, within 6 days.

This auction will be held before the commissionars Malgraeff en Persick.

The buyers pay 1 ½ percent church and poor money
